Making decisions about leaving your money and possessions is an important part of planning for the future.

If you are able to leave something for your relative with a learning disability, this could provide them with additional choices and flexibility in their life and enable them to spend money on things as their needs change. This should be done in a way that will be recognised in law rather than relying on a friend or relative to informally put it in place.

We'll look at:

  • Making a Will.
  • Discretionary Trusts.
  • Leaving your property in your Will.
  • Disabled persons’ Trusts.
  • Lifetime Trusts.
  • Appointeeship, Trusteeship and suitable persons.

  • ANY family that’s leaving something for a relative with a disability so that it doesn’t impact negatively on their home ownership or state disability benefits.

Key Deliverables

  • Review of existing Wills and Trust arrangements with suggestions and recommendations.
  • Meeting to draft a report that enables a qualified solicitor to create a suitable AND cost effective Trust (and Wills if required).
  • Creation of Lifetime Trust to include opening of Trustees’ bank account if required.
  • Help and guidance with appointing Trustees.
  • Letter of wishes to include relative’s mortgage options.
  • Creation of suitable Will for relative via Court of Protection.

Cost

  • £450 to review existing Wills & Trust with suggestions and recommendations
  • £950 to review existing Wills & Trust and draft a report that will enable the solicitor to create a suitable AND cost effective Trust (and Wills if required).
  • Relative’s Court of Protection Will £300
  • Solicitor to create Wills and Trust £350 – £500 plus VAT
